GENERAL TERMS AND CONDITIONS

Scope of application
These general terms and conditions apply to all orders placed by customers via the online shop of Army Shop Herzogenbuchsee GmbH, Lagerstrasse 19, 3360 Herzogenbuchsee BE, Switzerland

Offer and conclusion of contract
The presentation of the products in the online shop does not constitute a legally binding offer, but an invitation to order.
1. By clicking on the "Buy" button, the customer places a binding order for the products listed on the order page.
2. Immediately after receipt of the order, army-shop.ch confirms receipt of the order by e-mail. The purchase contract is only concluded when army-shop.ch confirms the dispatch of the goods by e-mail (order or order confirmation). The prices
3. stated on the product page include statutory VAT and other price components and are quoted in Swiss francs (CHF).

Prices and shipping costs
1. Prices are subject to change and errors excepted.
2. addition to the prices stated, shipping costs of CHF 7.90 will be charged for orders up to CHF 90. From CHF 90.- shipping is free of charge via Economy.
3. Depending on the size and weight of the goods, other shipping costs may apply. For bulky goods 25.- and for freight forwarders 90.- will be charged. The free delivery from 90.- is not valid.

Delivery conditions
1. Delivery is only made within Switzerland and the Principality of Liechtenstein.

We reserve the right to define which items we dispatch and how. When you place your order, you will only have the options available that match the products you have selected in your shopping basket. Prices are subject to change and errors excepted.
6. Should the delivery of the goods fail through the fault of the customer, army-shop.ch may withdraw from the contract and charge all costs incurred. Any goods paid for will be refunded after deduction of shipping costs and 20% of the value of the goods.

Minimum order value
1. A minimum order value of CHF 30 (value of goods) applies to all orders.

Terms of payment
1. Payment can be made by invoice (CembraPay), Twint, Postcard, Visa and MasterCard.
2. Unpaid orders are automatically cancelled after 30 days and are void.
3. Purchase on account (including payment by instalments) is processed by CembraPay AG. The General Terms and Conditions and the Privacy Policy of CembraPay AG shall apply.

Right of cancellation, exchange and exclusion of warranty
1. Consumers have the right to cancel or complain about the contractual declaration within 7 days of receipt of the goods under the criteria listed in points 7.2 - 7.8.
2. The cancellation must be sent to army-shop.ch in writing by e-mail or letter post. The time of dispatch of the cancellation (postmark or date of e-mail) is decisive for compliance with the deadline. A justification of the cancellation is mandatory. The declaration of cancellation must be sent to:

3. The following items will be taken back and 100% refunded or exchanged (shipping costs borne by army-shop.ch):

9. The following items can NOT be refunded or exchanged:
  - Underwear incl. underwear and underwear with a different size. Socks
  - Food and groceries
  - Ballistic protection items (once the life-saving protection items have left our control area, we can no longer guarantee the proper handling of the protection items by the receiving customer)
  - Antique, used or liquidation goods
  - products that have been inseparably mixed with other goods after delivery due to their nature
10. The exercise of the right of cancellation leads to the conversion of the purchase contract into a reversal relationship, according to which the services received under the purchase contract must be refunded. The consumer is obliged to return the goods received to army-shop.ch within 7 days of sending the cancellation notice. The cost of returning the goods shall be borne by the consumer. Returns that do not arrive within 7 days of the cancellation notice being sent cannot be accepted.
11. The items must be returned in their original, undamaged packaging and the labels must not have been removed. The items must also be unused and in perfect condition. Items without packaging or labels, or used items cannot be accepted. The items must be well packaged for the return.
12. If the cancellation is declared valid by army-shop.ch, the amount will be refunded in the same way as the customer paid. A deduction of a variable amount for possible damage, shipping costs or excessive wear and tear of the goods remains reserved. army-shop.ch can refuse the refund until it has received the goods back or until the goods have been returned. the consumer has provided proof that he has returned the goods.

Liability
army-shop.ch excludes liability for slightly negligent breaches of contract. The same applies to breaches of contract by auxiliary persons and substitutes.

Applicable law
These terms and conditions are subject to Swiss law. The place of jurisdiction for both parties is Bern / CH. The customer may not transfer rights and obligations arising from this agreement to third parties. In case of doubt, the version of the terms and conditions written in German is legally applicable. These terms and conditions replace all previous agreements between the parties.

Final provisions
Should any provision of these General Terms and Conditions be invalid, the remainder of the contract shall remain valid. The invalid provision shall be replaced by the relevant statutory provisions.
